By accepting for a shop, you confirm you are the seller or are authorised to act for the seller. You must have the right to sell each item and provide accurate descriptions, prices, photographs, defects, availability and payment/contact details. Do not list stolen, counterfeit, unlawful or unsafe prohibited goods. Respect copyright and other people's privacy.

Transactions belong to youRead guideClose guide

You are responsible for checking funds in your own account, confirming reservations, agreed discounts, refunds, disputes and collection arrangements. Do not mark a refund as recorded unless you have actually made it. Keep customer records accurate. BagsyThat does not collect or independently verify item payments or refunds and does not guarantee buyers or sales. Agree cancellation and deposit-return arrangements clearly with buyers and comply with applicable legal rights.

Customer information and processing instructionsRead guideClose guide

Use customer details only for managing the relevant sale, collection, necessary record-keeping and disputes. Establish an appropriate lawful basis, minimise collection, protect access and respond to applicable customer rights. Do not export customer information for unrelated marketing or disclose it to others without a lawful basis. You control your use of customer data for your sales. To the extent BagsyThat stores and processes those records on your behalf, you instruct it to do so to provide these tools, subject to lawful retention and security requirements. The operator separately determines processing for platform accounts, security and operation.

The operator will limit access to authorised persons, protect confidentiality, support verified rights requests through the available tools, and inform you without undue delay of discovered incidents affecting your shop. Report suspected account compromise or customer-data exposure promptly to the operator. Any future external hosting/email providers or material changes to processing arrangements must be disclosed and assessed before use. This agreement does not by itself authorise international transfers.

Security and retentionRead guideClose guide

Use a strong unique password and keep private order links and exported data secure. Grant access only to appropriate administrators. Review records when the transaction ends; use the privacy tools for verified requests and the published retention policy. Do not anonymise information still needed for an active order, unresolved dispute or applicable legal duty. Archived shops retain records until dealt with under the retention process; archiving alone is not erasure.

Hosting feesRead guideClose guide

There is no fee collection through this version of the platform. If a hosting/platform fee is introduced, its amount, duration, renewal, cancellation/refund terms and any access consequences must be disclosed and agreed before charging. Item payments remain separate. A hosting fee does not provide insurance, buyer protection or a guarantee of sales.

Moderation and ending accessRead guideClose guide

The operator may restrict access or remove listings reasonably needed to address unlawful content, misuse, security problems or a breach of this agreement. Where practicable, the operator will explain the reason and offer a way to raise a concern. Urgent protective action may be taken first. Ending access does not automatically erase records needed for outstanding transactions, lawful retention or rights requests.

Limitations and legal rightsRead guideClose guide

You remain responsible for your sales; the operator remains responsible for its own applicable platform and privacy obligations. Nothing here excludes liability that cannot lawfully be excluded or removes statutory rights. Kenyan law applies subject to mandatory protections. Material agreement changes require a new version and acceptance.
